Mediation Fundamentals

The CLDP, in partnership with the Judicial Legal Studies Institute (JLSI) in Bahrain, is organizing a workshop on mediation fundamentals, led by neutrals from JAMS – the world’s largest private alternative dispute resolution provider. Participants will:

  • Learn techniques for communicating with parties to understand both the parties’ overt considerations (e.g., monetary objectives) and their more private considerations (e.g., emotional considerations)
  • Understand strategies for achieving settlement, including coaching negotiations and recommending an outcome
  • Recognize how to structure mediation most effectively, including pre-mediation communications, joint sessions and caucuses, and memorialization of settlement terms
