Advanced ERISA Disability Mediation Techniques

About the EventJoin experienced JAMS mediator Adrienne Publicover as she moderates a webinar on mediation techniques unique to ERISA disability cases, together with panelists Cassie Springer Ayeni and Rob Forni. Topics include the effect on settlement of bringing concurrent (a)(3) and (a)(1)(B) claims; pros and cons of early mediation; ways to make the parties more amenable to settlement in advance of mediation; brackets and other resolution techniques; relationship building for the win; and insights on when to exchange briefs and documents. Panelists will also discuss commonly occurring issues and procedural defenses impacting settlement that counsel need to tactfully negotiate (e.g., inconsistent claims for disability benefits and employment discrimination, statute of limitations, failure to exhaust); overcoming disputes over benefit calculations; best use of evidence outside the record to support/defeat claims; and ethical considerations in negotiating settlements and drafting agreements.
