Hon. Michael E. Hegarty (Ret.) Joins JAMS, Offering Services Nationally
San Francisco – JAMS, the largest private provider of alternative dispute resolution (ADR) services worldwide, is pleased to announce that Hon. Michael E. Hegarty (Ret.) has joined its panel. Judge Hegarty joins JAMS with 19 years of experience as a federal judge in the U.S. District Court for the District of Colorado, including serving as the first chief U.S. magistrate judge in the district’s history during his final year on the bench.
On the bench, Judge Hegarty presided over 30 jury and 15 bench trials in areas such as antitrust, products liability, natural resources, personal injury, contracts and intellectual property. Beyond that, he was a prolific mediator, handling over 1,400 settlement conferences across practice areas, with a remarkable success rate. As a mediator, he has handled numerous high-profile cases, including the largest case in the history of the Federal Bureau of Prisons, a nationwide class action arising from the U.S. Department of State’s au pair program, lawsuits contesting Colorado’s Medicaid system and its system for bringing indicted persons to competency through mental health treatment and the Aurora theater shooting case.
Judge Hegarty is located in Colorado and will serve as an arbitrator, mediator, special master/referee and neutral evaluator, handling antitrust, business and commercial, civil rights, class action, employment, intellectual property, life sciences, personal injury and torts, professional liability and product liability matters. He is available to conduct sessions in person, as well as virtually, for clients across the country and internationally.
“Judge Hegarty possesses a deep understanding of the legal process, backed by experience as both a judge and a trial lawyer. He is known for his ability to handle high-profile and high-stakes cases and has a reputation for his ability to craft innovative solutions that meet parties’ needs. We are pleased to welcome him to our panel.”
Kimberly Taylor, JAMS CEO and president
Earlier in his career, Judge Hegarty served as a litigator with Washington, D.C., firm Arnold & Porter, where he focused his work on the substantive areas of securities, antitrust and environmental law. Later, as an assistant United States attorney, he gained extensive experience trying employment discrimination and other civil rights cases, as well as mediating employment cases within the Department of Justice nationwide. He also handled over 120 appeals to the federal circuit courts, including 12 oral arguments in the Second and Tenth circuits. Judge Hegarty’s experience as both a judge and a trial lawyer provide him with a great deal of insight into the legal process, thus enabling him to evaluate resolution options and efficiently guide parties to settlement.
“What I’ve learned on the bench and as a trial lawyer is how to approach a case to set parties up for effective resolution. While pathways forward and techniques implemented certainly vary, what holds true for each case is the power in understanding the facts and the nuances of parties’ perspectives and how those elements come together to resolve a dispute. I’m grateful for my many years on the bench, and I look forward to continuing my career with JAMS,” said Judge Hegarty.
Judge Hegarty earned his B.A., cum laude , Phi Beta Kappa, from Kansas State University and his J.D., Order of the Coif, from the University of Kansas School of Law.
